1. INTRODUCTION

This EULA, together with any applicable proposal, quotation, support agreement, Terms of Service, and Privacy Policy, sets out the conditions on which Enfixo makes its products and services available to you.

By downloading, installing, accessing, subscribing to, or using any Enfixo product, you agree to be bound by this EULA. If you do not agree, you must not use the product or service.

2. SCOPE OF PRODUCTS AND SERVICES

This EULA applies generally across Enfixo's portfolio, including but not limited to hosted platforms, web applications, mobile applications, SaaS tools, downloadable software, integrations, APIs, dashboards, billing systems, CRM tools, network tools, operational modules, and supporting documentation.

Some products or services may be subject to additional written terms. Where that happens, those specific written terms apply alongside this EULA.

3. LICENSE GRANT

Subject to your compliance with this EULA and any applicable commercial agreement, Enfixo grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the relevant product for your internal business operations or other permitted use approved by Enfixo.

This license is granted only for the period and scope agreed between the parties and does not transfer ownership of the product or any intellectual property rights.

4. PERMITTED USE

You may use Enfixo products only in accordance with their intended purpose, documentation, technical limitations, security controls, and any license metrics communicated to you, including user counts, device counts, locations, tenants, or service plans where relevant.

5. RESTRICTIONS

Unless Enfixo gives prior written permission or applicable law requires otherwise, you must not:

• copy, distribute, publish, sell, rent, lease, or sublicense any Enfixo product;
• modify, adapt, translate, reverse engineer, decompile, or disassemble the software;
• remove, conceal, or alter any copyright, trademark, confidentiality, or proprietary notice;
• use the product to provide timesharing, bureau, resale, or competing services to third parties unless expressly licensed for that purpose;
• attempt to bypass usage limits, authentication, security measures, or access controls;
• use the product in any unlawful manner or in violation of third-party rights.

6. ACCOUNTS, ACCESS, AND SECURITY

You are responsible for all activity occurring through your accounts, credentials, API keys, devices, and environments used to access Enfixo products.

You must maintain reasonable security safeguards and notify Enfixo promptly if you suspect unauthorized access, misuse, or a security incident affecting the product or related data.

7. DATA, PRIVACY, AND COMPLIANCE

Your use of Enfixo products may involve the collection, storage, transmission, or processing of operational, customer, employee, or usage data. You remain responsible for ensuring that your use of the product complies with applicable data protection, privacy, telecom, tax, financial, and industry-specific regulations relevant to your business.

Where personal data is processed, the use of that data is also subject to Enfixo's Privacy Policy and any applicable data processing terms agreed between the parties.

8. THIRD-PARTY SERVICES AND INTEGRATIONS

Enfixo products may interoperate with third-party software, devices, gateways, payment providers, hosting platforms, communication tools, or external APIs. Enfixo is not responsible for the availability, performance, security, legality, or continued compatibility of third-party services that it does not control.

Your use of those third-party services may be subject to separate license terms, privacy terms, and commercial conditions imposed by the relevant third party.

9. UPDATES, MAINTENANCE, AND CHANGES

Enfixo may release patches, upgrades, updates, configuration changes, security fixes, interface changes, or replacement components from time to time. Unless otherwise stated in writing, those changes form part of the licensed product and remain subject to this EULA.

Enfixo may also modify, suspend, or discontinue specific features where reasonably necessary for maintenance, security, legal compliance, or product improvement.

10. FEES AND COMMERCIAL TERMS

Where a product is provided on a paid basis, license fees, subscription charges, implementation fees, support fees, and renewal terms are governed by the applicable proposal, invoice, quotation, order form, or service agreement.

Failure to pay applicable fees may result in suspension, restriction, or termination of access in accordance with the relevant commercial terms.

11. OWNERSHIP AND INTELLECTUAL PROPERTY

All rights, title, and interest in and to Enfixo products, software, workflows, source code, object code, system design, interfaces, branding, documentation, and related intellectual property remain vested in Enfixo Technologies or its licensors.

Except for the limited license expressly granted in this EULA, no rights are granted to you by implication, estoppel, or otherwise.

12. TERM AND TERMINATION

This EULA remains in effect for as long as you use the relevant product or until the applicable license or service term expires or is terminated.

Enfixo may suspend or terminate access if you breach this EULA, fail to pay applicable fees, misuse the product, create security risk, or use the product in a way that may expose Enfixo or others to harm or liability.

Upon termination, you must stop using the affected product and, where applicable, delete or destroy all copies, credentials, documentation, and related materials in your possession or control.

13. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, Enfixo products are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Enfixo Technologies will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, business, contracts, goodwill, data, or anticipated savings arising from or related to the use of or inability to use any Enfixo product.

15. OTHER LEGAL DOCUMENTS

This EULA should be read together with Enfixo's Terms of Service and Privacy Policy. If a product-specific contract, statement of work, or enterprise agreement contains more specific terms for a product or customer relationship, that more specific written agreement will control for that product or relationship to the extent of any direct conflict.
